Reverted license for 153rd Insignia

[edit]

Hello there, I have reversed the license on the insignia that I created I drew and uploaded for the 153rd Mechanised Brigade. Since I created the insignia using paint.net based off an obscure photo, not being a direct copy, I hold copyright to this creation. This is because it can be deemed as my original work, as the insignia is definitely incorrect in some areas. Please avoid doing this, as I have released this work myself due to it being my creation. Thank you. Davomme (talk) 13:09, 25 May 2024 (UTC)[reply]

Hello @Davomme: , you are assuming that because you have redesigned this badge, the copyright belongs to you. Unfortunately, copying a badge from the Ukrainian public domain does not make you the holder of the rights to this image: the copier is not the rights holder. However, I will not ask for the removal of your image for the wrong license, but do not be surprised if a Russian propagandist asks for it. Since the invasion of Ukraine by Russia, Russian propagandists are very strict about Ukrainian media with a bad license. That being said, whatever you say, the author of this image is indeed the Ukrainian army. Whatever you say, this image is indeed in the Ukrainian public domain, whatever you say, there is indeed another version of this media on Commons, whatever you say, this image represents a military badge and should be converted to SVG format by a user specialized in this conversion, who will upload it to Commons. And whatever you say, this image represents a military badge and its use is restricted in all countries, for example, you do not have the right to wear it as is on a uniform.
I invite you, if you do not want an administrator to delete your work for the wrong license, to stop usurping the copyright on the badges of the Ukrainian army, but to properly register at the author level the template {{PD-UAexMilitary}} and at the license level the template {{PD-UA-exempt|type=patches}} which are the only two correct mentions for the badges of the Ukrainian army. This does not detract from your merit, simply, it protects your work against the excesses of zeal of some when it comes to “defending” Ukrainian rights for the sole purpose of removing information harmful to the Russian army.
For my part, I will no longer bother you by correcting your mistakes, and I will not bother you either by asking that your work not be deleted from Commons for the wrong license.

If that's the case, I'll apply the license in order so they can remain on Wikimedia commons/wikipedia. Davomme (talk) 16:16, 25 May 2024 (UTC)[reply]
I do the same with my personal uploads, but you can definitely write in the comments that you have completely redesigned this badge. In this case, you are the source of the image.
That being said, uploading badges myself, I know the work it represents, and I thank you for your uploads.
I do not know the rules for badges from other countries. For some countries, it is not clear at all, for others, the rights are reserved, but for Ukraine, it’s clear.
It will surely happen to me, if it hasn’t already, to upload another version of a badge that you have already downloaded. Don’t see any malice on my part, simply, I needed it for an article, and I couldn’t find it.
That being said, the quality of your image 153rd Mechanised Brigade Insignia.png is such that you could, in my opinion, convert it to SVG format for example using the free software Inkscape.
